EU and Swiss Safe Harbor Status
The United States Department of Commerce and the European Commission have agreed on a set of data protection principles and frequently asked questions (the "Safe Harbor Principles") to enable U.S. companies to satisfy European Union and Swiss law requirements for adequate protection of personal information transferred from the EU and Switzerland to the United States. The EU and Switzerland also has recognised the U.S. Safe Harbor as providing adequate data protection (OJ L 45, 15.2.2001, p.47). Consistent with its commitment to protect personal privacy, Xactware adheres to the Safe Harbor Principles as detailed below.
Xactware complies with the U.S.-EU Safe Harbor Framework and the U.S.-Swiss Safe Harbor Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information from European Union member countries and Switzerland. Xactware has certified that it adheres to the Safe Harbor Privacy Principles of notice, choice, onward transfer, security, data integrity, access, and enforcement. - NOTICE
Notice will be provided in clear and conspicuous language when individuals are first asked to provide personal information directly to us, or as soon as practicable thereafter, and in any event before we use the information for a purpose other than that for which it was originally collected.
We may disclose personal information if required to do so by law or to protect and defend our rights or property. We obtain personal information only as permitted by the “Safe Harbor” framework. Before we allow an individual to obtain or use our products or services, we may require the individual to provide consent for personal information to be collected, used, and/or disclosed in certain ways.
- CHOICE
Xactware offers individuals the opportunity to choose whether the personal information collected directly from individuals in the EU is: (a) to be disclosed to a non-agent third party or (b) to be used for a purpose other than the purpose for which it was originally collected or subsequently authorised by the individual. Xactware discloses your personal information only to an affiliated third party that receives PII from Xactware within a binding legal relationship pursuant to our instructions or on our behalf.
Xactware provides individuals with reasonable mechanisms to exercise their choices should requisite circumstances arise.
- DISCLOSURES AND ONWARD TRANSFERS
Xactware does not transfer onward or disclose personal information provided directly to Xactware from individuals in the EU to third parties except when one or more of the following conditions is true:
- Xactware has the individual's permission to make the disclosure.
- The disclosure is permitted by law or required pursuant to subpoena.
- The personal information to be disclosed is publicly available.
- ACCESS
If an individual becomes aware that personal information Xactware maintains about that individual is inaccurate, or if an individual would like to update or review his or her personal information, the individual may contact us using the contact information provided above. Xactware will take reasonable steps to permit individuals to correct, amend, or delete information demonstrated to be inaccurate or incomplete.
- SECURITY
Xactware will take reasonable precautions to protect personal information in its possession from loss, misuse and unauthorised access, disclosure, alteration and destruction.
- DATA INTEGRITY
Xactware will use personal information only in ways that are compatible with the purposes for which it was collected or subsequently authorised by the individual. Xactware will take reasonable steps to ensure that personal information is relevant to its intended use, accurate, complete, and current.
- ENFORCEMENT
Xactware will conduct compliance audits of its relevant privacy practices to verify adherence to our policies. Any employee that Xactware determines is in violation of its policies will be subject to disciplinary action up to and including termination of employment.
- CHANGES TO THIS PRIVACY STATEMENT
Xactware will occasionally update this Privacy Statement to reflect company and customer feedback. When Xactware posts changes to this Privacy Statement, you will see the word "updated" next to the Privacy Statement link on the front page of Xactware.co.uk. Xactware encourages you to periodically review this Privacy Statement to be informed of how Xactware is protecting your information.
